ดิฉัน นางสุรีย์รัตน์ ชิวารักษ์ แม่ของนายพริษฐ์ ชิวารักษ์ (เพนกวิน) นักศึกษาผู้ศรัทธาในประชาธิปไตย ผู้เรียกร้องเพื่อเรียกร้องสิทธิ เสรีภาพ และต่อสู้เพื่อการเข้าถึงทรัพยากรขั้นพื้นฐานของประชาชนคนไทยทุกคนอย่างเท่าเทียม ปัจจุบันเพนกวินเป็นนักศึกษาคณะรัฐศาสตร์ มหาวิทยาลัยธรรมศาสตร์ ซึ่งหากเราอยู่ในสถานการณ์ปกติ ในประเทศที่เป็นประชาธิปไตยโดยสมบูรณ์ เพนกวินคงจะเรียนจบในปีการศึกษาที่ผ่านมาด้วยคะแนนเกียรตินิยม และได้ใช้ชีวิตเป็นอาจารย์ที่เชี่ยวชาญในอารายธรรมล้านนาโบราณตามที่เขาหลงใหล ทว่าตอนนี้ ลูกชายดิฉันอยู่ในเรือนจำจากการถอนประกันในคดีที่ไม่เคยถูกตัดสินว่าผิด
ครั้นเมื่อมีการรัฐประหารโดยคณะรักษาความสงบแห่งชาติในปี พ.ศ. 2557 ตอนนั้นเพนกวินยังเป็นเพียงนักเรียนมัธยมคนหนึ่งที่ไม่สามารถเพิกเฉยกับความผิดปกติที่เกิดขึ้น เพนกวินไปร้องเรียนถามนายกรัฐมนตรีให้มีการปรับปรุงหลักสูตรการศึกษาที่รัฐบาลบังคับให้นักเรียนและเยาวชนท่องจำค่านิยม 10 ประการ เพนกวินเชื่อว่า การปลูกฝังการใช้เหตุผลให้รู้จักตั้งคำถามและหาคำตอบ เป็นพื้นฐานจริยธรรมที่สำคัญต่อเด็กและเยาวชนมากกว่าค่านิยมการเรียนการสอนแบบให้จำในสิ่งที่ไม่เข้าใจ อันเป็นสิ่งที่รัฐบาลเผด็จการทหารเท่านั้นจะพึงกระทำได้ และเพียงคำถามจากใจบริสุทธิ์ของลูกชายดิฉัน นั่นเป็นครั้งแรกที่เพนกวินถูกตำรวจจับกุมในชุดนักเรียน
ขณะที่เพนกวินยังเป็นนักเรียนมัธยม การต่อสู้ทางประชาธิปไตยเริ่มจากความสนใจในการศึกษาของเยาวชน เพนกวินใฝ่ฝันจะให้เด็กไทยทุกคนเข้าถึงการศึกษาอย่างเท่าเทียม ครั้งนั้นดิฉันอาจยังเป็นแม่ที่เห็นแก่ตัว เป็นแม่ที่ไม่อยากเห็นลูกเหนื่อย รับภาระที่ใหญ่กว่าตัวโดยไม่จำเป็น เพราะเขายังเป็นนักเรียนในสถาบันการศึกษาอันดับต้น ๆ ของประเทศอย่างเตรียมอุดมฯ ที่ต้องทุ่มเทเวลาในการเรียนและเพื่อเตรียมตัวสอบเข้ามหาวิทยาลัย อีกทั้งกิจกรรมอีกมากมายที่เขาไม่ได้ใช้ชีวิตอย่างวัยรุ่นทั่วไปในวัยเดียวกัน
ดิฉันเคยถามลูกว่า ทั้งหมดนี้ทำไปทำไม เพนกวินตอบแม่ว่า “ถึงแม้ว่ามี้จะเป็นคนจ่ายค่าเรียนให้กวิ้น แต่พวกเราก็ยังได้ใช้สวัสดิการบางอย่างจากรัฐที่มาจากจากภาษีของทุกคน ทรัพยากรขั้นพื้นฐานควรเป็นของเราทุกคน แต่คนบางกลุ่มกลับเข้าไม่ถึง และเราควรที่จะหาโอกาสทดแทนให้เขาเหล่านั้น”
“มี้ครับ หากในชีวิตหนึ่งของกวิ้น ไม่สามารถเปลี่ยนแปลงและช่วยเหลือสังคมให้ดีขึ้นได้ กวิ้นถือว่าเสียชาติเกิด” ดิฉันเองยังเคยบอกว่าช่วยแม่ซักผ้า ล้างจานก่อนก็ได้ ไม่เสียชาติเกิด แต่ด้วยความมุ่งมั่นของเขา ก็พยายามรณรงค์และผลักดันเรื่องการเรียนฟรีให้แก่เด็กนักเรียนจนประสบความสำเร็จ “ตายตาหลับแล้ว” เขาบอกกับดิฉัน เพราะได้บรรลุสิ่งที่เขาต่อสู้มาตามอุดมการณ์ที่เชื่อว่าคนสามารถเท่ากันได้กว่านี้
ต่อมาเพนกวินได้สอบเข้าเพื่อศึกษาต่อทางด้านรัฐศาสตร์ มหาวิทยาลัยธรรมศาสตร์ เขาได้เห็นภาพปัญหาของประเทศที่กว้างขึ้น จากความเหลื่อมล้ำทางโครงสร้างการศึกษา เพนกวินเริ่มเข้าใจมิติความไม่เท่าเทียมที่เริ่มจากการถูกลิดรอนสิทธิเสรีภาพในการแสดงความคิดเห็นและการแสดงออกสำหรับคนเห็นต่างทางการเมือง นำไปสู่การป้ายข้อหามาตราที่ปิดปากประชาชน หรือบุคคลสูญหายปริศนาขณะลี้ภัยในฐานะนักโทษทางการเมือง
เพนกวินเชื่อว่า ไม่สมควรมีใครถูกกระทำให้เป็นอาชญากร เพียงเพราะบุคคลนั้นได้ใช้เสรีภาพในการแสดงออกเพื่อเรียกร้องในสิทธิของตนที่รัฐไม่ได้แลเห็น
ขณะที่การยึดอำนาจเป็นเรื่องปกติ และการลงนามรับรองรัฐประหารเป็นเรื่องที่วิพากษ์ไม่ได้ ความไม่โปร่งใสจากรัฐบาลที่มาจากการรัฐประหารได้พาไปสู่การแก้ข้อกฎหมายให้สถาบันกษัตริย์มีอำนาจเหนือกฎหมาย ห้ามมิให้ผู้อื่นใดฟ้องร้องได้ เพนกวินเริ่มเห็นต้นตอของปัญหาความเหลื่อมล้ำที่ไม่ควรเกิดขึ้นในสังคมโลกสมัยใหม่ และเริ่มแสดงออกในฐานะประชาชน ว่าด้วยการโอนทรัพย์สินส่วนพระมหากษัตริย์ที่เป็นของสาธารณะกลับไปเป็นทรัพย์สินส่วนพระมหากษัตริย์ เพนกวินพยายามผลักดันให้การพูดถึงและตั้งคำถามต่องบประมาณสถาบันพระมหากษัตริย์เป็นเรื่องที่วิพากษ์วิจารณ์ได้อย่างตรงไปตรงมา เพื่อให้สถาบันกษัตริย์มีความโปร่งใส อยู่ใต้รัฐธรรมนูญเดียวกันกับประชาชน และอยู่นอกเหนือจากพื้นที่ทางการเมืองอย่างแท้จริง
ทว่า การบริหารโควิดของรัฐบาลในความสัมพันธ์กับสถาบันพระมหากษัตริย์ที่นำไปสู่การตั้งคำถามกับการผูกขาดวัคซีน และปฏิเสธไม่ได้ว่าเป็นการเพิกเฉยต่อประชาชนจำนวนมากที่ล้มตายจากการบริหารงานที่ล้มเหลว เพนกวินพยายามที่จะอภิปรายประเด็นนี้สู่สาธารณะในการชุมนุมเพื่อให้ข้อมูลในอีกด้านที่รัฐไม่มีทางนำเสนอแก่ประชาชน เป็นการเรียกร้องต่อรัฐบาลโดยสันติวิธี และขอร้องให้มีการปฏิรูปสถาบันกษัตริย์ให้อยู่เหนือการเมืองและใต้กฎหมายฉบับเดียวกันกับประชาชน แต่กลับถูกกล่าวหาว่าปล่อยข่าวปลอมจากกลุ่มผู้คลั่งชาติ และถูกดำเนินคดีมานับไม่ถ้วน น่าเศร้าใจที่ศาลก็รับฝากขัง ทั้งที่ยังไม่เคยเปิดการไต่สวนในห้องพิจารณาคดี
ในประเทศที่การวิพากษ์วิจารณ์พระมหากษัตริย์เป็นเรื่องต้องห้าม การร้องขอให้มีการปฏิรูปสถาบันกษัตริย์กลับเป็นการอาฆาตมาดร้าย เพนกวินและผู้ต้องหาทางการเมืองอีกหลายคนถูกกลุ่มผู้จงรักภักดีต่อราชวงศ์และปกป้องสถาบันกษัตริย์ฟ้องร้องแทนพระองค์ในมาตรา 112 ว่าด้วยการหมิ่นพระบรมเดชานุภาพพระมหากษัตริย์ไทย เป็นคดีอาญาที่มีโทษต้องจำคุกถึง 15 ปีต่อหนึ่งคดี และปัจจุบันเพนกวินถูกดำเนินเฉพาะข้อหานี้มาแล้วมากกว่า 10 คดี
หากเพนกวินถูกพิพากษาว่ามีความผิดจริง เพนกวินจะถูกจำคุกจนตาย
เพนกวินพยายามเรียกร้องขอสิทธิประกันตัวเพื่อออกมาสู้คดีภายนอกเรือนจำหลายครั้งจนถึงปัจจุบัน แต่ก็ไม่เคยได้รับอนุญาตให้ประกันตัว ในรอบหนึ่งปีที่ผ่านมา เพนกวินถูกคุมขังในเรือนจำถึง 3 ครั้ง กระทั่งในตอนนี้ก็ยังอยู่ในเรือนจำ ทุกครั้งเพนกวินพยายามที่จะขอโอกาสชี้แจ้งในศาล แต่ก็มิได้รับการตอบสนอง จนเมื่อโดนจับในครั้งที่ 2 เพนกวินก็พยายามที่จะขออธิบายกับผู้พิพากษาในศาลอีก แต่ผู้พิพากษาก็ไม่อนุญาติ จนนำไปสู่การประกาศอดอาหารประท้วงกลางห้องพิจารณาคดี ครั้งนั้นเพนกวินก็ถูกศาลสั่งลงโทษข้อหาละเมิดศาลเพิ่มเข้าไปอีก 15 วัน
ระยะเวลาอดหารในครั้งนั้น ยาวนานถึง 57 วัน นานกว่าการอดอาหารของมหาตมะคานธี เป็นสันติวิธีที่สุดเท่าที่เขาจะทำได้ในประเทศที่ระบบตุลาการละเมิดกฎหมายด้วยตัวเอง และนั่นเป็นช่วงเวลาที่ดิฉันแทบสิ้นใจ ได้ถามตัวเองว่าเป็นแม่แบบไหน ที่จะยืนดูดายอยู่ข้างนอก ปล่อยลูกค่อย ๆ ตายในเรือนจำที่พรากเสรีภาพและลมหายใจของเขาไป ดิฉันคิดอะไรไม่ออกว่าจะช่วยลูกยังไงได้ จึงขอปลงผม สละสิ่งที่ผู้หญิงคนหนึ่งจะหวงแหนได้มากที่สุดในร่างกาย เพื่อแลกกับเลือดเนื้ออีกชีวิตของดิฉันที่อยู่ในนั้น
เด็กคนนี้มันน่ากลัวอะไรขนาดนั้นหรือผู้มีอำนาจ ?
แม่คนหนึ่งไม่อาจนิ่งเฉยกับการถูกกล่าวหาว่าลูกเป็นอาชญากร เพียงเพราะเขาต้องการการเปลี่ยนแปลง ดิฉันกล้าพูดได้ว่า ดิฉันไม่ใช่แม่ที่ให้ท้ายลูก ดิฉันเลี้ยงดูลูกคนนี้มา รักมากขนาดไหน หากผิดย่อมว่าตามผิด แต่ดิฉันรับฟังสิ่งที่เขาจะสื่อสาร เพราะดิฉันไม่เชื่อว่าเป็นผู้ใหญ่ย่อมถูกต้องเสมอไป เขาไม่ใช่อาชญากรที่เป็นภัยต่อสังคม เขาเป็นเพียงเด็กวัย 20 ปีที่ควรได้ใช้ชีวิตอย่างที่ใฝ่ฝัน ได้ใช้ความรู้ความสามารถที่ถนัดในทางที่เขาชอบ และเมื่อเขาตั้งคำถามต่อผู้มีอำนาจ สิ่งที่เขาได้รับไม่ใช่คำตอบที่อยู่บนเหตุผล แต่กลับเป็นคดีความที่สั่งให้เขาปิดปากอย่าถามไปเสียได้
ณ ขณะที่ท่านได้อ่านจดหมายฉบับนี้ เพนกวิน ลูกชายของดิฉันก็ยังคงถูกจองจำจนติดโควิดในเรือนจำ และก็ไม่ได้รับการอนุญาติให้ส่งตัวออกมารักษาในโรงพยาบาลที่ได้มาตรฐานข้างนอกเรือนจำ เพนกวินไม่มีสิทธิที่จะได้เลือกการรักษาเพื่อให้เขามีชีวิตอยู่ต่อ ขณะที่ฝ่ายรัฐนอกจากจะกักขังเพนกวินไว้ในเรือนจำแล้ว ยังพยายามทุกวิถีทางที่จะกลั่นแกล้งให้เพนกวินไม่สามารถมีชีวิตอยู่ต่อไปได้
วันแรกที่ดิฉันได้คุยกับลูก เมื่อรู้ว่าลูกได้ยาผิด ก็วิตกว่าลูกจะมีจุดจบเหมือนหมอหยอง เพราะบางวันโรงพยาบาลราชทัณฑ์ก็ลืมที่จะให้ยารักษาโควิดกับเพนกวิน นี่ยังไม่นับรวมถึงความพยายามกีดกันไม่ให้ทนายและครอบครัวเข้าเยี่ยมเพื่อรับรู้ความเป็นไปของเพนกวินได้
นอกจากเพนกวินแล้ว ตอนนี้ฝ่ายรัฐได้เริ่มเข้ามาคุกคามคนในครอบครัว ตำรวจส่งหมายดำเนินคดีมาให้ดิฉัน ที่เพียงแต่ไปนั่งฟังการปราศรัยในการชุมนุม และอยากขอยุติธรรมให้ลูกโดนสันติ ดิฉันไม่ได้ขึ้นปราศรัยอะไรทั้งสิ้น แต่กลับถูกภาครัฐดำเนินคดีเช่นเดียวกับที่ลูกดิฉันโดนกระทำ
ในฐานะแม่คนหนึ่งที่พยายามจะช่วยลูกชายที่โดนรังแกจากผู้มีอำนาจ ไม่ว่าจะเป็นผู้ปกครองประเทศ ผู้บริหารประเทศ หรือระบบตุลาการ เพียงเพราะแค่เขามีความตั้งใจมั่นในการ เปลี่ยนแปลง แก้ไข ประเทศบ้านเกิดเมืองนอนที่เขารัก ให้มีประชาธิปไตยสมบูรณ์ เพื่อความเป็นอยู่ที่ดีและการเข้าถึงทรัพยากรสวัสดิการขั้นพื้นฐานอย่างเท่าเทียมของประชาชนทุกคน ดิฉันไม่มีอำนาจใดจะไปต่อกรกับผู้ที่มีทั้งอาวุธ และกฎหมายในมือได้ หวังเพียงแต่ว่า ท่านทั้งหลายผู้อยู่ในประเทศที่มีระบอบประชาธิปไตยอย่างสมบูรณ์อย่างแท้จริงจะช่วยเป็นกระบอกเสียงหรือยื่นมือมาเพื่อช่วยเรียกร้องความยุติธรรมให้กับข้าพเจ้าและลูกชาย รวมทั้งประชาชนคนไทยคนอื่นที่ลุกขึ้นมาเพื่อเรียกร้องสิทธิ เสรีภาพ ประชาธิปไตย ที่กำลังถูกรัฐเผด็จการในประเทศศักดินาคุกคาม
ด้วยความบริสุทธิ์ใจและห่วงใยต่อชีวิตลูกชายในเรือนจำไทย

Dear Prime Minister and Minister of Finland
I am Mrs. Sureerat Chiwarak, mother of Mr. Parit Chiwarak (Penguin), a student who believes in democracy, an advocate who demands rights, liberties and equal access to basic resources for all Thai people. Penguin is currently a student of the Faculty of Political Science at Thammasat University. If this were a normal situation in a fully democratic country, Penguin would have graduated this past academic year with honors. He could be a teacher specializing in ancient Lanna civilization, which he was passionate about [Lanna is a region in modern-day Northern Thailand]. But now my son is in prison because bail was withdrawn in a case for which he hasn’t been convicted.
When the 2014 National Council for Peace and Order coup took place, Penguin was just a high school student who couldn’t ignore the strange irregularity of what had happened. Penguin went and petitioned the prime minister to change an educational curriculum imposed by the government that was forcing students and youth to memorize “10 Values.” Penguin believes that cultivating reason so one knows how to ask questions and find answers is a better basis for morality for children and youth than teaching values by rote without understanding. Only a military dictatorship is able to impose such rules. It was just a question from the innocent heart of my son. That would be the first time Penguin would be arrested while wearing a school uniform.
Penguin’s struggle for democracy began out of an interest in youth education while he was still a high school student. Penguin dreamed that all Thai children would receive equal access to education. Back then, maybe I was a selfish mother–one who didn’t want to see her child wear himself out unnecessarily by taking on a burden so much bigger than himself. Because at that time he was still a student in one of the country’s top schools, Udom Preparatory School [Triam Udom Suksa School], and needed to devote time to studying and preparing for university entrance exams. Additionally his many activities meant that he did not have a life like others his age.
I used to ask my son, “Why do you do all this?” Penguin replied, “Even if it is you Mom paying for my education, we still get some welfare benefits from the state coming from everyone’s taxes. Basic resources should belong to all of us. But some groups can’t access it. So we should find another compensating opportunity for them.”
“Mom, if in my one life I am not able to change and help society improve, I would consider my life to be wasted.” As for myself, I said “So how about you help your mother wash the clothes. And first wash the dishes. [Then] you won’t waste your life!” But with his determined commitment, he tried to campaign and push for free education for students until he succeeded. “I died and my eyes are now closed,” he told me because he had achieved what he fought for according to the ideology that people could be more equal.
Later on, Penguin took the entrance exam to study political science at Thammasat University. He saw a broader picture of the country’s problems. From disparities in the educational structure Penguin began to understand the dimensions of inequality, which begins with deprivation of the right to free expression, and [especially] the expressions of political dissidents. This leads to section of the law that gags the mouths of the citizens [Article 112] or to the mysterious disappearance of individuals who flee the country because of political charges.
Penguin believes nobody deserves to be criminalized simply because they have exercised their freedom of expression to petition for rights of theirs that the state fails to recognize.
When seizing power is a normal story and signing off on coups [by the king] is something that cannot be criticized, governments resulting from the coups lack of transparency, and this lack of transparency leads to amending the law that can cause the damages to the monarchy’s reputation. No other person is allowed to file a lawsuit [against the king]. Penguin was beginning to see the root of the problem of social disparities that should not arise in the modern world, and began to express himself as a citizen about a transfer to the king of a part of the royal property that belongs to the public. Penguin has been pushing to make the royal budget something that can be spoken of, questioned, and criticized in a straightforward manner, so that the monarchy can have transparency, be under the same constitution as the people, and truly stay outside of politics.
But the government’s administration of covid-19 in its relationship to the monarchy has led to questions about vaccine monopoly [the contract for making the AstraZeneca vaccine went to an obscure company, Siam Bioscience, which is owned by the King]. One can’t deny, it is indifference to the huge numbers of people who have died because of administration and its failure. Penguin tries to publicly explain this issue at rallies to provide another side’s information, which the state has no way to offer to the public. It’s a call to the government by peaceful means and a petition for the reform of the monarchy to be above politics and under the same law as the citizens. But nationalist groups went and accused Penguin of spreading fake news and now he has had innumerable cases filed against him. Sadly, the court has imprisoned him although there was never an investigation opened in a courtroom.
In a country where criticizing the monarch is taboo and forbidden, a call for reforming the monarchy is [viewed as] malicious. Penguins and several other political figures have been sued by royal loyalists and defenders of the monarchy on his behalf under Article 112 for insulting the majesty of the Thai king. It is a criminal offense punishable by up to 15 years in prison per case. At this time, Penguin faces more than 10 such charges.
If Penguin is actually convicted, he will we in prisoned until his death.
Penguin has repeatedly, up until the present, tried to claim his right to bail so he can come out and fight his case outside prison. But he is never allowed bail. Just in the past year, Penguin was imprisoned three times and is still in prison now. Every time Penguin tried to ask for a opportunity to explain in court, he received no response. Then at his second arrest, Penguin tried to explain to the judge in court again, but the judge wouldn’t allow it; this led to Penguin’s announcement of a hunger strike in the middle of the courtroom. Penguin was then sentenced to 15 days more for contempt of court.
The period of fasting at that time was 57 days. That’s longer than Mahatma Gandhi’s fast. It was the most peaceful way Penguin could do [things] in a country where the judicial system itself violates the law. And that was the moment I nearly died. I asked myself what kind of mother I was to stand and watch outside, let my child slowly die in a prison that took away his liberty and his breath. I couldn’t figure out how to help my child, so I shaved off my hair. I sacrificed what a woman cares most about with regard to her body, in exchange for the flesh and blood, another life of mine, that was in there.
This child is really all that terrifying, or powerful?
A mother cannot remain silent when someone accuses her child of being a criminal just because he wants a change. I dare say I’ve never been a mother who panders to her child, automatically taking his side. I raised this child. However much I love him, if he’s wrong, I’ll admit he’s wrong. But I listened to what he was saying. Because I don’t believe that adults are always right. He is not a criminal, which threatens society. He’s just a 20-year-old boy who deserves to live life as he dreams, to use his knowledge, abilities, and skills in the way that he likes. And when he asked questions of those in power, what he received was not an answer based on reason, but instead a lawsuit that ordered him to shut his mouth and not ask.
As you read this letter, Penguin, my son, remains incarcerated and has contracted covid-19 in prison. And they refused to send him to a standard hospital outside the prison for treatment. Penguin doesn’t even have the right to choose a treatment that might keep him alive. The government, in addition, to confining Pengiun in prison is trying every possible way to not let him continue to live.
The first day I talked to my son, when I learned that my son had gotten the wrong medicine, I was worried that my child would have an ending like Mor Yang [an astrologer accused of lese majesty law who died in a prison hospital November 7, 2015, under suspicious circumstances.] Because some days, the prison hospital would forget to give Penguin the medicine to treat his covid. Not to mention their trying to prevent Penguin’s lawyer and family from visiting to learn how he is doing.
Besides threatening Penguin, those on the side of the government have now started to come threaten people in his family. The police sent me a notice of proceedings against me––me who just sat and listened to speeches at the rally, and want to peacefully ask for justice for my child. I didn’t get up [on stage] and speak at all. But I was still charged by the government just the same as was done to my son.
My son has been bullied by the people with power (whether the ruler of the country, the administration, or the judicial system) all because he is determined to change, to fix, his beloved country so it has full democracy, so all the citizens can have a good life and equal access to basic resources; as his mother, I have no power to put up a fight against those who have both weapons and the law in their hands. I only hope all of you good people who live in a country with real and full democracy will help be a megaphone, or raise your hands, to help demand justice for me and my son and other Thais who have risen up to demand rights, liberties, and democracy who are being threatened by a dictatorship in a feudal country.
